Customer Feedback Program Promotion Terms and Conditions
1. The Customer Feedback Program promotion is organised by Astute Financial Management Pty Ltd ABN 59 093 587 010 (‘Astute’) Level 1, 155 Baroona Road, Rosalie, Queensland 4064.
2. Astute makes no warranties about the accuracy of the information below and may change the terms and conditions of the offer without notice.
3. Astute reserves the right to limit entry or amend rules if considered necessary without notice.
4. Information on how to enter promotion and prizes form part of the Terms and Conditions. By entering the promotion, you acknowledge that you have read and understand and agree to be bound by these terms and conditions.
5. Entry is only open to Australian residents, aged 18 or older except employees and staff and their immediate families of the promoter.
6. To enter, entrants must complete the Astute Customer Satisfaction Questionnaire in its entirety, confirm their consent in Question 14 of the questionnaire form and submit their answers within ten (10) days of the email invitation being sent to them by Astute. In addition, in order to be eligible to win a prize, the selected entrant must have already entered into a loan agreement through an Astute member and the loan agreement must be in place as at the Draw date. Astute will accept only one entry per household.
7. All promotion entries will become the property of Astute. All valid entries will automatically go in the minor prize draw with the first valid entry drawn to win. All entries are deemed to be received at the time of receipt into Astute’s database, NOT the time of transmission by the entrant. No responsibility is accepted for late, lost or misdirected entries.
8. Prize values are in Australian dollars. The prize winner should be aware that tax implications may arise as a result of claiming the prize and should seek independent financial advice prior to claiming the prize. Astute is not responsible for tax implications that may arise from the prize winnings.
9. The result of any promotional prize draw is final and no correspondence will be entered into. The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10. If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the loan account is held.
11. The Customer Feedback Program promotion commences 08/02/2010 and concludes at 11.59pm AEST on 17/01/2011. Entries into the minor promotional prize draw close for each draw at 11.59pm on the dates specified in the table below. All minor prize draws will take place at 11:00am at Astute, Level 1, 155 Baroona Road, Rosalie, Queensland 4064 on the dates specified in the table below. Valid entries into each minor prize draw will NOT be entered into any subsequent minor prize draws. All valid entries into the minor prize draws will be entered into the major prize draw. The major prize draw will take place at 11:00am on the 01/02/2011 at Astute, Level 1, 155 Baroona Road, Rosalie, Queensland 4064. All times indicated are AEST.

12. All prize winners will be notified by phone and mail on the draw date. Minor prize draw details will be published on www.astutefinancial.com.au/Competition Results and major prize draw details will be published in the Australian. Unclaimed prize draws to be held at 11.00am on 01/05/11 at Level 1, 155 Baroona Road, Paddington QLD 4064.
13. Prizes are not redeemable for cash, however if the nominated prize is not available at the time of draw, Astute may in its sole and unfettered discretion substitute the prize for equivalent items (including cash).
14. The winners’ personal information may be disclosed to State and Territory lottery departments as required by law and the winners’ names published as required under relevant legislation.
15. A copy of the Astute Privacy Policy may be obtained by visiting www.astutefinancial.com.au/PrivacyPolicy and following the relevant links. A request to access, update or correct any information should be specifically directed to Astute at Level 1, 155 Baroona Road, Rosalie, Queensland 4064.
16. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter, reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and subject to written directions from State Regulatory bodies, cancel, terminate, modify or suspend the competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this competition or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
17. Astute accepts no responsibility for any accident, loss, injury or damage to any individual or property arising out of or in connection with either Draw or the prizes, either during or after the Draws.
18. The entrant releases from and indemnifies the Promoter against all liability, cost, loss or expense arising out of the entrant’s participation in the Promotion, or breach of these terms and conditions, including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
